Larisa Munteanu graduated as a top student from the Faculty of Law of Babeș-Bolyai University, Cluj-Napoca, Romania, then gained experience in data protection in the UK. She is now the Founder of Protector PriVit and a CIPM and CIPP/E Data Protection Lawyer and Officer, accredited by the IAPP. Her main interests are cyber-crimes, data protection and AI, working for both private and public sector clients.
In parallel, Larisa is a PhD researcher at Erasmus University Rotterdam, where she is conducting an analysis on how companies can (legally) reject data protection requests hiding malware attacks in the EU and UK. She also has numerous publications, being a speaker for many international conferences, webminars, podcasts, and trainings.
In 2022, Larisa won the Best International Future Lawyer Award, and more recently, her expertise was recognised by the Court of Justice of the European Union, where she delivered training on data protection, copyright and AI.

“Manifestly” tricky – How can one word in data protection laws facilitate complex malware attacks?

Worldwide legislators have reckoned the increasing value of personal data, but so did cyberattackers. Therefore, one may expect legislation to provide sufficient safeguards or ideally, to design a regulatory environment in which businesses can flourish and personal data can be easily protected against any threats. Yet, leaving daydreaming aside, it is a given that malicious actors will always creatively attempt to circumvent both corporate and legal “firewalls”.
So, how can companies legally say “No” to data protection requests that disguise malware attacks? Can one word from data protection laws impact cybersecurity? Do detectability levels or origin make a difference? This presentation will answer all these questions, based on the data protection laws of the EU, UK and complementarily, Japan. Both short- and long-term solutions will be suggested. In the end, companies are not legislators, but can always use other weapons at hand.
